ELIGIBILITY
Kellwood Company, LLC d/b/a Democracy Clothing’s The Democracy Clothing Spring Break Wardrobe Giveaway (the “Sweepstakes”) is open to teachers, school staff, and administrators who are U.S. residents 18 and older at the time of entry. Employees of Kellwood Company, LLC d/b/a Democracy Clothing (the “Sponsor”), and its affiliates, partners, subsidiaries, franchises, distributors, advertising and promotion agencies, and the immediate families or household members of each are not eligible to enter. Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law or regulations. Winning a prize is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER
Sweepstakes Period: Beginning on April 2, 2026 at 11:59pm PST through May 17, 2026 at 11:59pm PST, log on to https://democracyclothing.com for The Democracy Clothing Spring Break Wardrobe Giveaway and follow the on-screen entry instructions. All online entries must be received by May 17, 2026 at 11:59pm PST.
Entry: To be eligible, you must fill in all required information, including but not limited to, your first and last name, school name, current academic year, and the accredited educational institution where you are a teacher, faculty, or staff. Also, to be eligible, you must submit a valid email address. Entry is free. One (1) entry per person is permitted. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. All entries and requests become the property of Sponsor and will not be acknowledged or returned.
By entering the Sweepstakes, you authorize Sponsor to communicate with you via email, phone, voice mail messaging or by text messaging to communicate Sweepstakes information.
SELECTION OF WINNERS
Three (3) Prize Winners will be selected in a random drawing on or about May 18, 2026 (from among all eligible entries submitted during the Sweepstakes Period) conducted by representatives of Sponsor. Potential winners will be notified by email on or about 3 business days and will be given instructions on how to claim prizes. Potential winners may be required to sign and return an affidavit of eligibility and liability release (and, where permitted, a publicity release) within 30 business days of the date on the notification or prize will be forfeited and awarded to an alternate potential winner. If a potential winner cannot be contacted, fails to execute and return the requested documents within the required time period, fails to claim a prize within 30 days after being contacted, or prize is returned as undeliverable, or he/she refuses his/her prize for any reason, potential winner forfeits the prize, and Sponsor will select an alternate potential winner by random drawing. If a potential winner is considered a minor in his/her jurisdiction of residence, the potential winner’s entry shall be declared void, as it is in contravention of these rules and/or applicable law, and a new winner shall be selected at random. Odds of winning depend on the number of eligible entries received. A potential winner is not an official winner (“Official Winner”) until potential winner’s eligibility has been verified and potential winner has been notified that verification is complete. A potential winner will be verified by Sponsor via email or phone call, and potential winner will provide either an educator ID card with a valid date or a screenshot with URL of faculty listing on the school/district website.
Official Winners will be announced on May 20, 2026 at 12:00pm PST.
PRIZES
One (1) Prize Winner will receive a $500 Democracyclothing.com gift card with a monetary value of $500 that is only redeemable at https://Democracyclothing.com. Two (2) Prize Winners will each receive a $250 Democracyclothing.com gift card with a monetary value of $250 that is only redeemable at https://Democracyclothing.com.
Prizes will be awarded "as is" with no warranty or guarantee, either express or implied offered by Sponsor.
No more than the stated number of prizes in these official rules will be awarded. Each Official Winner will be responsible for any and all prize-related expenses, including without limitation any and all applicable federal, state and/or local taxes. If required by applicable laws, an Official Winner will be required to provide information sufficient to issue a 1099 to each Official Winner, declaring the value of the Prize. Prize is non-transferable and no substitution by any potential winner or cash equivalent is allowed. Sponsor reserves the right to substitute prize for one of equal or greater value.
ACCEPTANCE OF OFFICIAL RULES
As a condition of entry, you fully and unconditionally agree to these Official Rules and to the Sponsor’s decisions, which are final and binding in all respects.
ENTRY ERRORS
Sponsor is not responsible for lost, late, incomplete, damaged, stolen, invalid,
unintelligible or misdirected entries or information. Sponsor is not responsible if online service is interrupted including without limitation (1) interruptions to any network, server, Internet, Web site, telephone, satellite, computer or other connections, (2) failures of any telephone, satellite, hardware, software or other (3) garbled, misdirected or jumbled transmissions, or traffic congestion, (4) other errors of any kind, whether human, technical, mechanical or electronic, (5) the incorrect or inaccurate capture of entry information or the failure to capture any such information, or (6) any printing or typographical errors. If for any reason your entry is confirmed to have been erroneously lost, or otherwise destroyed or corrupted, your sole remedy is another entry in the Sweepstakes.
PUBLICITY
As a condition of entry, you grant Sponsor and its agent’s permission to use your name, likeness, voice, and biographical information for publicity or advertising in any media or manner, without further payment, consideration, notice or approval and without geographic or time limitation (collectively, "Likeness") in connection with the Sweepstakes or any derivative works we make from the Sweepstakes, including to advertise and promote the same or any future giveaway. You waive the right to inspect or approve any use of your Likeness as contemplated in these rules.
By entering the Sweepstakes, you agree to receive email newsletters periodically from Sponsor. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the newsletter.
CONDITIONS OF PARTICIPATION
Conduct. Sponsor reserves the right in their sole discretion to modify, cancel,
terminate, and/or suspend the Sweepstakes and to disqualify any individual for any reason. Including, but not limited to, an individual who tampers with the entry process, violates these official rules, or acts in a disruptive or unsportsmanlike manner. In the event that the Sweepstakes is terminated early, Sponsor reserves the right, but not the obligation, to award prizes in a random drawing from among the eligible entries received prior to the date of termination. Without limiting the foregoing, Sponsor reserves the right to disqualify any individual and may lock out any entrant who, in their sole judgment, tampers with the entry process or the operation of the Sweepstakes, who acts in violation of these Official Rules including acting in an unsportsmanlike or disruptive manner or has questionable eligibility or is otherwise ineligible to enter.
WARNING: Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
DISPUTE RESOLUTION AND CHOICE OF LAW
THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually through arbitration, without resort to any form of class action, and exclusively by Judicate West - Santa Ana in Orange County, California ; (2) that the laws of the state of California shall govern, without regard to its conflict of laws principles; (3) that the parties hereto waive any right to a trial by jury, and (4) any and all claims, judgments and awards shall be limited to actual out-of pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees, (5) under no circumstances will you be permitted to obtain awards for punitive, incidental, special, consequential or other damages, including without limitation, lost profits (collectively, “Special Damages”); and (6) any entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
FEES AND COSTS.
Each entrant shall bear and pay, without any right of reimbursement from Sponsor, all costs, fees, and expenses incurred by it or on its behalf in connection with this Sweepstakes under the California Rules of Discovery without limitations.
LIMITATION OF LIABILITY.
By entering the Sweepstakes, you agree to release and hold harmless Sponsor and each of their respective subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may arise out of or in relation to the Sweepstakes, directly or indirectly, whether caused by negligence or not, including but not limited to (i) your participation in the Sweepstakes and/or your acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries.
